AT HIGH POINTE

TREE POLICY

This policy governs homeowners' and HPPID responsibilities for the maintenance and/or removal of any trees that are located in common-areas or homeowner's property and impedes common-area right-of-ways such as streets and sidewalks.

I. PURPOSE: [Modified from: Cedar Hill Ordinance Article XVI. Landscape Regulations, Sec. 4-331]

To enhance the beautification of the High Pointe Subdivision, to safeguard and enhance property values; and to protect the public health, safety and general welfare of our citizens.

II. DEFINITIONS: [Modified from: Cedar Hill Ordinance Article XVI. Landscape Regulations, Sec. 4-332]

Application. Unless otherwise provided, these regulations shall apply only to that property to be used as or developed for single-family residential use located in the HPPID.

Clearance. [Modified from: Cedar Hill Ordinance Article IV. Visibility On Streets, Obstructions And Fire Hydrant Clearance., Sec. 19-71] Height above streets and sidewalks. No tree, shrub, vine or similar plant shall be grown, maintained or cultivated in such manner so that any portion of such tree, shrub, vine, etc., may overhang or obtrude upon or over any dedicated alleyway or street in High Pointe, unless there be a full thirteen and one-half (13 ½) feet clearance between the surface of all portions of such alleyway or street and the overhanging tree, limb, shrub, vine or plant of any description or kind. Sidewalks will have a minimum clearance of eight (8) feet above the surface of the sidewalk.

Common Area Tree. A tree, as defined below, that were procured and installed by the HPPID and planted in common areas of High Pointe such as in the medians and common-area landscaped beds.

HPPID. The Cedar Hill Public Improvement District #1 at High Pointe.

Lot. Land consisting of one (1) single-family residential lot in use or to be developed for a single-family home.

Owner. That person who has legal title to the property, or a lessee, agent, employee or other person acting on behalf of the titleholder with authorization to do so.

Owner Tree. Any tree on an owner lot that impedes a common-area such as trees that impede safe passage on sidewalks or streets.

Protected Tree. A tree designated by the owner or the city which may have historical designation, act as a local landmark, or provide soil stability in existing streams or creek beds, or have a trunk circumference of sixty (60) inches or more, measured four and one-half (41/2) feet above natural grade.

Pruning. The act of trimming a tree sufficiently so that branches do not impede access to public walkways, driveways or streets.

Removal. The act of removing a tree by cutting or uprooting the main trunk of the tree enough so that no part of the remaining tree is visible above the ground and any remains will not cause a safety hazard to humans, animals or equipment.

Tree. A tree shall be defined as follows and will qualify as such if any of the following are met:

(1) A woody plant having a present height greater than ten (10) feet and a trunk diameter greater than two (2) inches;
(2) A plant listed as a tree in any of the following:
(a) A tree listed in the selected plant list provided by the city;
(b) A tree listed in "The Trees of North Texas" by Robert Vines.
(3) A Crepe Myrtle, Red Tip, Cherry Laurel or other large shrub.
III. HPPID RESPONSIBILITY FOR COMMON AREA TREES:
If a Common-area tree is damaged solely by weather, age, disease, or other natural means, the cost of removal and/or replacement of the tree will be assumed by HPPID at its sole discretion.

HPPID will not remove any tree designated as a Protected tree without the approval of the City of Cedar Hill.

HPPID will actively maintain, water, treat and prune Common-area trees.

Common area trees shall not impede public right-of-ways and shall be pruned and/or replaced accordingly by the HPPID.

IV. OWNERS' RESPONSIBILITY FOR OWNER TREES:

If an Owner tree is damaged solely by weather, age, disease, or other natural means, the removal of the tree will be the responsibility of the Owner.

Owners will not remove any tree designated as a Protected tree without the approval of the City of Cedar Hill.

Owner trees shall not impede public right-of-ways; therefore, Owners are responsible for maintaining proper Clearance of all Owner trees by proper Pruning and/or Removal.

Owners are responsible for maintaining, watering, treating and pruning of Owner trees.
